In its last decision of the 2007-2008 term the U.S. Supreme Court decided in a 5 - 4 vote that:
"The Second Amendment protects an individual right to a firearm unconnected with service in a militia and to use that arm for traditionally lawful proposes, such as self-defense within the home."

“There seems to us no doubt, on the basis of both text and history, that the Second Amendment conferred an individual right to keep and bear arms,” Scalia said.
